Clerks and Arbitrators should use this section to clarify their understanding of the final decision—at a minimum, a list of items that have passed. Additionally, a list of which remedies are conditional on others (for instance a ban that should only be implemented if a mentorship should fail), and so on. Arbitrators should not pass the motion to close the case until they are satisfied with the implementation notes.

These notes were last updated by 17:21, 19 May 2023 (UTC); the last edit to this page was on 17:21, 19 May 2023 (UTC) by Izno.

Request for Arbitration declined

This is a courtesy notice to inform you that a request for arbitration, which named you as a party, has been declined. Feel free to see the Arbitrators' opinions for potential suggestions on moving forward.

For the Arbitration Committee,{{safesubst:</includeonly#if:|| ~~~~}}

Template:Arb premature

In response to your request for arbitration, the Arbitration Committee has decided that arbitration is not required at this stage. Arbitration on Wikipedia is a lengthy, complicated process that involves the unilateral adjudication of a dispute by an elected committee. Although the Committee's decisions can be useful to certain disputes, in many cases the actual process of arbitration is unenjoyable and time-consuming. Moreover, for most disputes the community maintains an effective set of mechanisms for reaching a compromise or resolving a grievance.

In all cases, you should review Wikipedia:Dispute resolution to learn more about resolving disputes on Wikipedia. The English Wikipedia community has many venues for resolving disputes and grievances, and it is important to explore them instead of requesting arbitration in the first instance. For more information on the process of arbitration, please see the Arbitration Policy and the Guide to Arbitration. I hope this advice is useful, and please do not hesitate to contact me or a member of the community if you have more questions. ~~~~

Template:ArbComOpenCase/Evidence

Anyone, whether directly involved or not, may add evidence to this page. Please make a header for your evidence and sign your comments with your name.

When placing evidence here, please be considerate of the arbitrators and be concise. Long, rambling, or stream-of-consciousness rants are not helpful.

As such, it is extremely important that you use the prescribed format. Submitted evidence should include a link to the actual page diff; links to the page itself are not sufficient. For example, to cite the edit by Mennonot to the article Anomalous phenomenon adding a link to Hundredth Monkey use this form: [https://en.wikipedia.org/?title=Anomalous_phenomenon&diff=5587219&oldid=5584644] [1].

This page is not for general discussion - for that, see talk page.

Please make a section for your evidence and add evidence only in your own section. Please limit your evidence to a maximum 1000 words and 100 diffs, a much shorter, concise presentation is more likely to be effective. Please focus on the issues raised in the complaint and answer and on diffs which illustrate behavior which relates to the issues.

If you disagree with some evidence you see here, please cite the evidence in your own section and provide counter-evidence, or an explanation of why the evidence is misleading. Do not edit within the evidence section of any other user.

Be aware that the Arbitrators may at times rework this page to try to make it more coherent. If you are a participant in the case or a third party, please don't try to refactor the page, let the Arbitrators do it. If you object to evidence which is inserted by other participants or third parties please cite the evidence and voice your objections within your own section of the page. It is especially important to not remove evidence presented by others. If something is put in the wrong place, please leave it for the arbitrators to move.

The Arbitrators may analyze evidence and other assertions at [[Wikipedia:Requests for arbitration/{{{1}}}/Workshop|/Workshop]]. /Workshop provides for comment by parties and others as well as arbitrators. After arriving at proposed principles, findings of fact or remedies voting by Arbitrators takes place at [[Wikipedia:Requests for arbitration/{{{1}}}/Proposed decision|/Proposed decision]]. Only Arbitrators may edit /Proposed decision.

Place argument and diffs which support your assertion, for example, your first assertion might be "Jimmy Wales engages in edit warring". Here you would show specific edits to specific articles which show Jimmy Wales engaging in edit warring

Place argument and diffs which support the second assertion, for example, your second assertion might be "Jimmy Wales makes personal attacks". Here you would show specific edits where Jimmy Wales made personal attacks.

all proposed

After considering [[Wikipedia:Requests for arbitration/{{{1}}}/Evidence|/Evidence]] and discussing proposals with other arbitrators, parties and others at [[Wikipedia:Requests for arbitration/{{{1}}}/Workshop|/Workshop]] place proposals which are ready for voting here.

Arbitrators should vote for or against each point or abstain.

  • Only items that receive a majority "support" vote will be passed.
  • Items that receive a majority "oppose" vote will be formally rejected.
  • Items that do not receive a majority "support" or "oppose" vote will be open to possible amendment by any Arbitrator if she/he so chooses. After the amendment process is complete, the item will be voted on one last time.

Conditional votes for or against and abstentions should be explained by the Arbitrator before or after his/her time-stamped signature. For example, an Arbitrator can state that she/he would only favor a particular remedy based on whether or not another remedy/remedies were passed.

On this case, {M} Arbitrator(s) is/are recused and {N} is/are inactive, so {14-M-N} out of 14 arbitrators are available and { floor((14-M-N)/2)+1} votes are a majority.

For all items

Proposed wording to be modified by Arbitrators and then voted on. Non-Arbitrators may comment on the talk page.

Motions and requests by the parties

Place those on [[Wikipedia:Requests for arbitration/{{{1}}}/Workshop|/Workshop]].

Proposed temporary injunctions

Four net "support" votes needed to pass (each "oppose" vote subtracts a "support")
24 hours from the first vote is normally the fastest an injunction will be imposed.

Hi, {{subst:BASEPAGENAME}}. I'm an arbitration clerk, which means I help manage and administer the arbitration process (on behalf of the committee). Thank you for making a statement in an arbitration request at Wikipedia:Arbitration/Requests/Case. However, we ask all participants and commentators to limit the size of their initial statements to 500 words. Your statement significantly exceeds this limit. Please reduce the length of your statement when you are next online. If the case is accepted, you will have the opportunity to present more evidence; in any event, concise, factual statements are much more likely to be understood and to influence the decisions of the arbitrators.

Requests for extensions of the word limit may be made either in your statement or by email to the clerks email list.

For the Arbitration Committee,

User:L235/ArbClerk/Templates/EvidenceSize

Hi, {{subst:BASEPAGENAME}}. The Arbitration Committee has asked that evidence presentations at [[Wikipedia:Arbitration/Requests/Case/{{{2}}}/Evidence]] by parties be kept to around 1000 words and 100 diffs. Your presentation is over {{{1}}}. Please edit your section to focus on the most relevant evidence. If you wish to submit over-length evidence, you must first obtain the agreement of the arbitrators by posting a request on the /Evidence talk page.

For the Arbitration Committee,

Template:Arbitration standard provisions

Enforcement of restrictions

0) Should any user subject to a restriction in this case violate that restriction, that user may be blocked, initially for up to one month, and then with blocks increasing in duration to a maximum of one year.

In accordance with the procedure for the standard enforcement provision adopted 3 May 2014, this provision did not require a vote.

Appeals and modifications

0) Appeals and modifications

This procedure applies to appeals related to, and modifications of, actions taken by administrators to enforce the Committee's remedies. It does not apply to appeals related to the remedies directly enacted by the Committee.

Appeals by sanctioned editors

Appeals may be made only by the editor under sanction and only for a currently active sanction. Requests for modification of page restrictions may be made by any editor. The process has three possible stages (see "Important notes" below). The editor may:

  1. ask the enforcing administrator to reconsider their original decision;
  2. request review at the arbitration enforcement noticeboard ("AE") or at the administrators’ noticeboard ("AN"); and
  3. submit a request for amendment at "ARCA". If the editor is blocked, the appeal may be made by email through Special:EmailUser/Arbitration Committee (or, if email access is revoked, to arbcom-en@wikimedia.org).
Modifications by administrators

No administrator may modify or remove a sanction placed by another administrator without:

  1. the explicit prior affirmative consent of the enforcing administrator; or
  2. prior affirmative agreement for the modification at (a) AE or (b) AN or (c) ARCA (see "Important notes" below).

Administrators modifying sanctions out of process may at the discretion of the committee be desysopped.

Nothing in this section prevents an administrator from replacing an existing sanction issued by another administrator with a new sanction if fresh misconduct has taken place after the existing sanction was applied.

Administrators are free to modify sanctions placed by former administrators – that is, editors who do not have the administrator permission enabled (due to a temporary or permanent relinquishment or desysop) – without regard to the requirements of this section. If an administrator modifies a sanction placed by a former administrator, the administrator who made the modification becomes the "enforcing administrator". If a former administrator regains the tools, the provisions of this section again apply to their unmodified enforcement actions.

Important notes:

  1. For a request to succeed, either
(i) the clear and substantial consensus of (a) uninvolved administrators at AE or (b) uninvolved editors at AN or
(ii) a passing motion of arbitrators at ARCA
is required. If consensus at AE or AN is unclear, the status quo prevails.
  1. While asking the enforcing administrator and seeking reviews at AN or AE are not mandatory prior to seeking a decision from the committee, once the committee has reviewed a request, further substantive review at any forum is barred. The sole exception is editors under an active sanction who may still request an easing or removal of the sanction on the grounds that said sanction is no longer needed, but such requests may only be made once every six months, or whatever longer period the committee may specify.
  2. These provisions apply only to contentious topics placed by administrators and to blocks placed by administrators to enforce arbitration case decisions. They do not apply to sanctions directly authorised by the committee, and enacted either by arbitrators or by arbitration clerks, or to special functionary blocks of whatever nature.
  3. All actions designated as arbitration enforcement actions, including those alleged to be out of process or against existing policy, must first be appealed following arbitration enforcement procedures to establish if such enforcement is inappropriate before the action may be reversed or formally discussed at another venue.
In accordance with the procedure for the standard appeals and modifications provision adopted 3 May 2014, this provision did not require a vote.

Template:Subpage evidence

In relation to your evidence submissions at [[Wikipedia:Arbitration/Requests/Case/You did not declare the name of the case!/Evidence#Section title was not declared in the template!]], please be aware that the Arbitration Committee does not take evidence on subpages into account. Please remove the link to all such subpages from the Evidence page, and transfer what material you want to submit for consideration to your own section (within the confines of the word limit). Thank you,

Request for Arbitration declined

This is a courtesy notice to inform you that a request for arbitration, which named you as a party, has been declined. Feel free to see the Arbitrators' opinions for potential suggestions on moving forward.

For the Arbitration Committee,{{safesubst:</includeonly#if:|| ~~~~}}

Only Arbitrators may edit /Proposed decision.

all proposed

Discussion by Arbitrators Information

General

Motion to close

Implementation notes

Clerks and arbitrators should use this section to clarify their understanding of the final decision--at a minimum, a list of items that have passed. Additionally, a list of which remedies are conditional on others (for instance a ban that should only be implemented if a mentorship should fail), and so on. Arbitrators should not pass the motion until they are satisfied with the implementation notes.

Vote

Four net "support" votes needed to close case (each "oppose" vote subtracts a "support")
24 hours from the first motion is normally the fastest a case will close.

  1. ask the enforcing administrator to reconsider their original decision;
  2. request review at the arbitration enforcement noticeboard ("AE") or at the administrators’ noticeboard ("AN"); and
  3. submit a request for amendment at "ARCA".

Thank you,
