Dispute FUR on this image, it is taken from a website with the notice at the bottom of the home page which says All information, logos, and usage of material on this site is the sole property of the NCAA and its institutions. Any reuse of this information without the express written consent of the NCAA is prohibited.. The picture of the helmet can be replaced by a free one, by anyone with a camera at a game, the Logo on the side of the helmet will make probably make that part a derivative work but there is no reason to use this image. The issue is that this is a non-free file and NFCC says that we need to go with a suitable free use replacement if there's one available. The Kellogg company isn't the topic of the article, but families in advertising, which means that any suitable free use image of a family in an ad can replace this file.
At first, I'd hoped to be able to just re-license this file as PD-pre 1978. Because I'm not certain this ad wasn't cropped and that Kellogg's had a copyright notice on it, based on their past history of copyrighting almost all ad/promotional materials, I can't truly say this ad didn't have a copyright notice on it. We don't know what magazine this was taken from, so we can't look back and see another copy of the ad to look for a notice. It isn't a matter of good faith here, but a matter of complying with NFCC.
