  • Comment: Won't necessarily argue this is a DM case (since the ad does take up quite a bit of space on the bus), but I'd rather think of this case by considering the incidental policy (which is included in the DM page of Commons), and some of such files had been kept on Commons/undeleted after a UDR previously (see here, here and also here for examples). Though I'm not sure whether NZ (source of origin of photo) has a copyright policy on either DM or incidental inclusion (NZ wasn't included in the DM page), so I will wait until someone can offer an explanation of the law in NZ before giving my opinion.     Section 41 of the New Zealand copyright code contains the same regulation as Section 31 of the UK Copyright Code, clarifying explicitly that incidental inclusion in an artistic work - a term which includes photographs - does not constitute copyright infringement. The subject played from 1938-50, and since I have been unable to trace the image at the website given as a source it is unclear whether the photograph was taken pre- or post-1946, the cut-off date for URAA restoration. Thank you very much for the detective work! There actually seems to be a 1939 photograph available, the third one from the bottom here.

Copyright restored in the USA by the URAA as Australian copyright did not expire before 2005. While Brian Clay seems eligible for a non-free picture, there are better ones available (see e. g. [2]); however, I assume that in the spirit of choosing the freest image possible we should choose a pre-1955 image that is at least out of copyright in its home country Australia.
