Thanks for adding the lead image. Another image, such as the 2nd from the left on the top row of this gallery is a good example of his steamboat paintings. The commentary about those is explained beginning with the 3rd paragraph in his career section. {{ Template:Non-free use rationale}} could describe the image as a painting of a steamboat by Albert Nemethy, one of many steamboat paintings made which he became widely recognized for. The purpose of the image is to illustrate the specific commentary about his steamboat artworks.

Another one, such as the top left of another gallery, could do the same for commentary included in his career section in the 2nd to last paragraph. The painting is "after Alfred Bierstadt's" "Rocky Mountains" painting from 1863. The article states, "He also painted large landscapes with native American themes in the style of Albert Bierstadt."

Since those two subjects are among those he was noted for painting, an example of each would be useful, as they also show his range. What I was getting at, though, is: can you actually fill out two fair use rationales for me to use when uploading the images? Sorry for the confusion; I would have used the generic "please provide a fair use rationale" message that the FFU template generates, but I was worried it would be confusing with one already uploaded and two not. Your previous version of the upload request indicated that the image had been published in a newspaper article. What is the name of the newspaper? What was the date of publication? When was the photo actually taken? If this info can be provided, I'll upload the image under a claim of fair use, since the subject is deceased, which does not require proof that Emily Hughes has agreed to freely license the image. Per WP:NFC, copyrighted fair use images on Wikipedia are supposed to be low enough resolution so that the image can't be reused for commercial purposes. Generally an image has to be below 100,000 pixels, so for a square image like this the maximum size is 316x316. It's most likely uncropped as this was not a typical 8 x 10 press released photo, but an 11" x 14" photo. This is similar to File:Woody Allen - Kup.JPG which was 10 x 13 and was uncropped. Such larger original photos are much rarer and often uncropped. As for where it was first published, the facts that this was from the film (see another example) and was obviously professionally shot, as opposed to being a candid, implies that it was made for publication. Some other uncropped 11 x 14 photos: George Lazenby, George Clooney, and Al Pacino.

The film was distributed by MGM. The U.S. copyright law explains that for publicity photos like these, "publication" takes place when the photo is offered or distributed. "The offering to distribute copies or phonorecords to a group of persons for purposes of further distribution, public performance, or public display constitutes publication. A public performance or display of a work does not of itself constitute publication.” The fact that the photo exists implies publication, since it's unlikely it was taken for his personal use only. As noted, a photo sold by a dealer as "original" is not cropped. Also, the standard size for photo paper was 11 x 14, which this photo's dimension is. It could not have been cropped except if printed from an 16 x 20 sheet, which would be unlikely. It would be logical to assume it's free. I have never seen a movie publicity photo that had all film info printed on the front, including details like the actors's name, film title, studio, plot, and even a photo ID mark, but had a copyright notice on the reverse. This photo was not cropped. The sellers, with whom I've corresponded with for similar photos, does not sell cropped photos, which can not be called "original." If it was cropped, they would have said so. FYI, 5x7 is the final photo size, and photo paper only came in standard sizes, ie. 5x7, 8x10, 11x14, 16x20. Those were the only sizes available. There's nothing on either dise of this to indicate the date. The example of File:Joan Blondell - 1936.jpg at Commons appears to have a copyright notice on the original upload at lower left that reads: "Copyright Vitagraph Inc. All rights reserved. Copyright is waived to newspapers and magazines." The Blondell photo is licensed as having no copyright marks. I once more ask User:Masem to offer an opinion re: whether this should be uploaded. For the record: The user has been the subject of a CCI for some time. In November 2014 he was blocked from uploading images here. The user asked for the ban to be lifted here in March 2015. The user has been blocked from Commons for the same concerns since November 2013.These questions were brought up at AN and ANI previously, not at an upload board. The front of the image, near the bottom, has some odd digital artifacts that I wonder if there was some editing done before posting to ebay. All the other issues that may make it copyrighted appear to be checked, it would be helpful to know what copyright search terms were done just to make sure (since this would needed to have been registered in 5 years to get copyright). -- MASEM ( t) 18:52, 8 August 2015 (UTC) reply

The process I use to check for registration:

Go to U.S. Copyright search page;

Click on "Set Search Limits" at bottom right;

Select from Item Type: "Visual Materials",

Set a date range; (note that I never bother with a date range since I've yet to come across a publicity photo for a film that was ever copyright registered, much less renewed. I therefore will look at all years.)

Return to main search page, then, using the "Keyword" selector from the list, enter the name of the film or person (if it's just a head shot) in the "Search for" box. (The reason I use the Keyword option is because it allows the most variable parameters, as described on the page.)

Check the results, noting that all images will have the letters "VA" and a number for initial registrations and "RE" if it was a renewal. Hope this helps. -- Light show ( talk) 19:54, 8 August 2015 (UTC) reply

And also for the record, another distinct type of copyright, which requires its own copyright, is that for "Motion Pictures." Motion Picture copyrights use the designation of "PA" in front of the number. Therefore a publicity photo from a movie, even if it was taken during production, has a different copyright than the movie itself. Description: This image is the official coat of arms for the Wexford Collegiate School for the Arts (high school) in Toronto, Ontario. This will replace the current school picture to be consistent with high schools in Toronto that use their coat of arms/crest for their official Wikipedia picture. This picture is used through the official Facebook & Twitter pages of the school, and the current image is no longer accurate due to improvements on the school property.

Comment: Do you really want all 4 images uploaded? The article isn't very long, and having 4 old logos which aren't all that different in the History section might clutter it up a bit.
