Hmm. The page itself has a cc-by-sa-2.5 tag at the bottom of the right-hand menu. But under the photo itself it says cc-by-nc-nd-2.5. I'd say it should be deleted. –

Unfree image of a living person (to quote from the
license template used for this image:"Please note that our policy usually considers fair use images of living people that merely show what they look like to be replaceable by free-licensed images and unsuitable for the project"). As an excuse, it is stated that this "is a reclusive author"; this claim is totally unsubstantiated. On the contratry,
here are several photos of him speaking at a fairly recent public gathering,
Google Image search finds many more photos of him posing on public occasions. (Also the uploader commenting "fair use images of the author are impossible to fi[nd]" while uploading a fair use of the author, and "It is widely used across the internet, and so may be free use" does not demonstrate a good understanding of fair use and copyright issues.)

No physical CD or album exists. This image is a marketing image for a digital download, and fair use does not cover this usage.

Keep. So it's a virtual CD cover. Shouldn't we treat it the same way as if it were a real CD cover? It's being used to illustrate the song, so I'd say it's relevant and non-replaceable. –

Kept as a result of no consensus. A Virtual CD may still fall under the cd-cover fair use guidelines of Wikipedia. A wider consensus and input should be sought to resolve this.
