I think referring to him as a Republican is a little misleading. 1.) There is no source for that statement. Is he a registered republican? 2.) His appointments are by both republican and democrat presidents 3.) federal judgeships are non-partisan and no other federal judge I can think of is referred to as being a member of party, even judges who once worked in a political job (e.g., Elena Kagan an Solicitor General.)
