Image:ApeCaveSlime.jpg) for a bit? I know it's been a long while since I've had time to do any work here, but I still want to overhaul the
Ape Cave article, and it badly need interior images. I don't know much about image deletion policy, though, so if this is a problem, go ahead and delete it.

This and the picture below are fotos of the article Brian wrote in a local article, so this basically shows the Wikipedians what he does. I'd say it's POV, and "CopyrightedFreeUseProvidedThat|it is attributed to Brian Burnell as the photographer." makes no good impression. --

Just an aside - perhaps he would license it under cc-by since that is what he seems to be doing - "The copyright holder allows anyone to use it for any purpose, provided that Brin Burnell is attributed as the author and photographer." Allowing any use (a license) for any purpose (no nc or other caveats) provided that Brian is attributed (require attribution). This is really no different that a cc-by license, 'unless he expects attribution on each page on which it is used. Which is different, and if so should be removed. --

The fair use claim (Wikipedia boilerplate) says "for identification and critical commentary on the station ID or program and its contents". Well, this image certainly does identify the program's contents, i.e. the subject of the article, Andrew Marr. This is one that should be retained until a better (clearer) image comes along. A better case can be made for deleting other images.

Delete and re-upload modified version. I don't think it's necessarily a copyright violation as-is, but it should be modified to more clearly support grounds for fair use. It should include the copyright notice. I don't think it necessarily has to be redacted, but it should not be of such high quality that one could use it in a forgery, but maybe just good enough quality for commentary purposes. See, for example,
this page from an
Ex-Mormon site which doesn't appear to have been sued by the church yet (although it's pretty dicey since the author seems to be promoting temple recommend fraud). Maybe, for extra caution, somebody could put some red lettering over the top such as "NOT VALID", or fill in the form with "John Doe" information. Having it black-and-white instead of the original yellow is a good thing, from a strictly legal point of view.

Protect The image is not a copyright violation, it meets the requirements for 'fair use'. Most importantly the image is not used for profit by the LDS, its also not a work that its author is claiming recognition for. Concerns about the document being used for fraud are not at issue for copyright violations. Also readacting portions of the original if anything strengthen a fair use argument because less of the original is being used.

Whether the image is used for profit is immaterial; copyright law is concerned with whether the value of the material is materially diminished. In this case, the value of the temple recommend is the certification it provides for the bearer. If the image makes it straightforward to create forged recommends, the value of the document is diminished because the certification becomes much less reliable. Such a scenario is not likely to be protected under fair use. Also, you are incorrect about the author not claiming recognition for it; if that were so, the (unredacted) recommend would not have the copyright notice on it. If fair use can be applied to this image, it would in my opinion have to be because the loss of color and the redactions make it difficult to use it for forgery. In the age of Photoshop, I'm not sure whether these changes are sufficient, but perhaps they are. But it would be better to have an image that is less borderline than this one AND contains the copyright notice, so that a clear fair use rationale can be provided and it doesn't appear that someone's trying to evade the copyright.

The fair use claim (Wikipedia boilerplate) says "for identification and critical commentary on the station ID or program and its contents". Well, this image certainly does identify the program's contents, i.e. the subject of the article, Andrew Marr. This is one that should be retained until a better (clearer) image comes along. A better case can be made for deleting other images.

Delete and re-upload modified version. I don't think it's necessarily a copyright violation as-is, but it should be modified to more clearly support grounds for fair use. It should include the copyright notice. I don't think it necessarily has to be redacted, but it should not be of such high quality that one could use it in a forgery, but maybe just good enough quality for commentary purposes. See, for example,
this page from an
Ex-Mormon site which doesn't appear to have been sued by the church yet (although it's pretty dicey since the author seems to be promoting temple recommend fraud). Maybe, for extra caution, somebody could put some red lettering over the top such as "NOT VALID", or fill in the form with "John Doe" information. Having it black-and-white instead of the original yellow is a good thing, from a strictly legal point of view.

Protect The image is not a copyright violation, it meets the requirements for 'fair use'. Most importantly the image is not used for profit by the LDS, its also not a work that its author is claiming recognition for. Concerns about the document being used for fraud are not at issue for copyright violations. Also readacting portions of the original if anything strengthen a fair use argument because less of the original is being used.

Whether the image is used for profit is immaterial; copyright law is concerned with whether the value of the material is materially diminished. In this case, the value of the temple recommend is the certification it provides for the bearer. If the image makes it straightforward to create forged recommends, the value of the document is diminished because the certification becomes much less reliable. Such a scenario is not likely to be protected under fair use. Also, you are incorrect about the author not claiming recognition for it; if that were so, the (unredacted) recommend would not have the copyright notice on it. If fair use can be applied to this image, it would in my opinion have to be because the loss of color and the redactions make it difficult to use it for forgery. In the age of Photoshop, I'm not sure whether these changes are sufficient, but perhaps they are. But it would be better to have an image that is less borderline than this one AND contains the copyright notice, so that a clear fair use rationale can be provided and it doesn't appear that someone's trying to evade the copyright.
