I would have PRODded this, but I wonder whether the image is eligible for copyright in the US. This cover art contains just red stars, plain typeface used for the artist's name and the song title, and blue background. Keep CD1. My rule of thumb is that if an additional image for one version of a song can be described in words, don't add it. This has just been proven, so the digital artwork should probably be removed regardless of copyright concerns. Most of Rothko's (late) work is equally as "simple" as this one. If you were correct, none of his work would be eligible for copyright protection. I doubt that {{ PD-simple}} was intended to apply to works of art. Vexations ( talk) 13:44, 21 October 2021 (UTC) reply
Threshold of originality says that in the US, copyright protection can be granted to works of authorship that possess at least some minimal degree of creativity. Also, the original source from the Solomon R. Guggenheim Museum states "© 1998 Kate Rothko Prizel & Christopher Rothko / Artists Rights Society (ARS), New York". You're not suggesting that the Rothko estate is making a false copyright claim though, are you? Just that sometimes other people do so? The article Rothko case has some background info on the estate, and might help to convince folks that Kate Rothko does indeed hold the copyright. Vexations ( talk) 17:40, 21 October 2021 (UTC) reply
  • The US Copyright office provides this guidance on registering copyrights for visual art works. Reviewing the examples doesn't resolve issue of copyrightability for me. In explaining to me why the National Gallery of Canada's acquisition of Voice of Fire was not a boondoggle, an artist friend once explained that the stripes, shapes, and any other elements in works also have brush technique adding visual texture to the work. I'm not sure how the US copyright office would view that argument. There is visual texture apparent in the painting. This looks like one of those things that sit at the borderline. "The Ballad of Paul K" cover turns out to be part of promotional release and shouldn't be used ( discogs, ebay). All other covers may be okay to use, but using more than one may violate WP:NFCC#3a, and any one of them may also fail WP:NFCC#8. The drawing/animation cover was used for the DVD release ( discogs, ebay). However, either CD or digital release is more preferred, so I think DVD one should go. Keep CD1. This is an article for a single—a musical composition released commercially—so the promo "Ballad" artwork and DVD artwork should definitely go. As for the CDs, I'd usually go for the artwork used most frequently internationally, but since it wasn't released outside the British Isles, this turns into more of a numbers game. Seeing as neither artwork has achieved a solid sense of identity in the UK, we could go without one or the other, but one comes before two, so CD2 so be removed. Keep CD. Being a fan of food, I personally find the re-release covers more enticing. However, the original artwork (i.e. the red-and-white 7-inch) is what I generally prefer using in articles, but since the re-release was more success and there are no other infoboxes in the article, it might be wiser to use the most widely known artwork. Keep CD1. In 2003, the 7-inch single was much less popular than the CD, so that image should be deleted. As for the CD images, if one of them is deleted, it can easily be recreated with words. I still don't think the sample meets WP:NFCC#8 when used at the singer article and the band article. However, the original artwork (i.e. the red-and-white 7-inch) is what I generally prefer using in articles, but since the re-release was more success and there are no other infoboxes in the article, it might be wiser to use the most widely known artwork. Keep CD1. In 2003, the 7-inch single was much less popular than the CD, so that image should be deleted. As for the CD images, if one of them is deleted, it can easily be recreated with words. Currently used at Doug Hopkins, Found Out About You, and Gin Blossoms. The sample was de-PRODded, citing one critic's quote, haunting, almost psychedelic quality to the interweaving guitar lines, as sufficient enough to keep the sample. Hmm... I wonder. I still don't think the sample meets WP:NFCC#8 when used at the singer article and the band article.
