This is an image of a three dimensional work of art, and therefore a derivative image. In the United States there is no Freedom of Panorama for works of art other than buildings, so the question becomes whether the work of art is de minimis in the image. Possibly suspicious image: the Contact Us page of the official website of PSE bears this image that, if downloaded, has identical resolution (230x284px). Reverse Google Image search reveals it was used on http://senorenrique.blogspot.com/2006/09/exchange.html?m=1 (September 2006), about a year prior to this upload (June 2007). However, the source information indicates: "Photo publiée dans le n°14 - 1942. Artur Grimm / Signal". This means the photographer wasn't dead for more than 100 years.
