This is an image of a three dimensional work of art, and therefore a derivative image. In the United States there is no Freedom of Panorama for works of art other than buildings, so the question becomes whether the work of art is de minimis in the image. Possibly suspicious image: the Contact Us page of the official website of PSE bears this image that, if downloaded, has identical resolution (230x284px). The only difference is the file format, but I suspect this enwiki hosted file as radically edited one (the original is .jpg, this one is .gif). Possibly stolen somewhere from the Internet. Reverse Google Image search reveals it was used on http://senorenrique.blogspot.com/2006/09/exchange.html?m=1 (September 2006), about a year prior to this upload (June 2007). The image URL there is http://static.flickr.com/89/248189249_55b378e35c.jpg?v=0 (possibly once hosted at Flickr but now untraceable there).     @ M.nelson: FOP basis is not applicable for this nomination, as enwiki only respects US law and applies US architectural FOP to all unfree buildings from no FOP countries. That's why enwiki has w:File:Burj Khalifa.jpg but Commons deleted their copy of it. However, I aired my concern at Template talk:FoP-USonly#On images tagged with FoP-USonly, because while enwiki only follows US law, it is accessible in countries where US law does not apply, like ours (we use English Wikipedia more than Tagalog Wikipedia, which is not accessed by 9 out of 10 Filipinos, pageview stats verify this). My concern wasn't noticed, however, and eventually I decided a compromise proposal to reword the template (at Template talk:FoP-USonly#Suggested revised wording), to add a warning for people from no FOP countries tonot reuse the unfree buildings' images here for commercial purposes. However, the source information indicates: "Photo publiée dans le n°14 - 1942. Artur Grimm / Signal". This means the photographer wasn't dead for more than 100 years.
