"Because it is a non-free logo, there is almost certainly no free representation. Any substitute that is not a derivative work would fail to convey the meaning intended, would tarnish or misrepresent its image, or would fail its purpose of identification or commentary." Any image that is similar enough to this image to be useful would be a derivative work ie. "reproduce the work or any substantial part thereof in any material form whatever" (section 3 of the Copyright Act), "A 'derivative work' is a work based on a previous work that has a significant original addition" (Ottawa Law Review 39 (1)), "Derivative Work means a work that produces or reproduces the Work or any substantial part thereof in any material form... You must keep intact all copyright notices for the Work and give credit" (CC licence), "all transfers of a creative, copyrightable work into a new medium count as derivative works" (Commons-What is a Derivative Work?), etc. trackratte ( talk) 17:08, 30 May 2014 (UTC) reply
There is no point in quoting invalid statements from the fair use rationale. Heraldic images are replaceable by a freely licensed drawing based on the same blazon. See for example Wikipedia:Files for deletion/2013 July 17#File:Arzachena-Stemma.png. -- Stefan2 ( talk) 17:45, 30 May 2014 (UTC) reply
Based solely on the blazon without any reference to the original drawing, and no attempts made to replicate the orginal drawing based on prior knowledge of the original. Those three points come from British and Canadian case-law. The only reason why blazon based images are acceptable is because ideas cannot be copyrighted. However, if elements and compositions which are not described in the blazon are included in the image, then it is a copyright violation as attempts to copy the original image were clearly made. So, careful analysis must be made WRT the image and the claimed source.
The blazon here is simply "Azure a fouled anchor surmounted by an eagle volant affronty head to the sinister Or", or something like 'on blue a gold anchor 'set loose' surmounted by a golden flying eagle facing us with its head bent to the left". As you can see, the angle of the anchor, the placement and composition of the rope, the type of anchor and chain, the maples leaves, ribbon, etc are all not explained in any detail. So, if a work were to mimic the original to such an extent that it would be any use as a reprentation of the official badge, then it would then be a derivative of the original according to copyright law, and thus a copy vio.
For example, if the flag of Canada were copyrighted, and it was explained as a red maple leaf on a field of white between two red bars, and I drew the exact same 11-pointed maple leaf between two bars of the same dimensions and height, then that is a clear derivative. If I drew a stylised 24-rounded-point maple leaf in between two thin bars (one above the maple leaf and one below), then I've clearly drawn a non-derivative image based solely on the blazon with no reference, either directly or by memory, to the copyrighted depiction.
Thus, the automated standard FUR statement of "Because it is a non-free logo, there is almost certainly no free representation.
