Due process cases should be categorized as due process cases, regardless of whether the operative clause was in the 5th or 14th amendment, i.e. whether the federal or state governments were at issue. The doctrinal differences between 5th and 14th amendment due process are negligible, if they exist at all. Distinguishing between these cases should be done by list, if at all, not by category.
