I have a few comments here. Firstly, this is not a valid RFC. There is a template that must be used - see the main RFC page again. No matter how bizarre the behaviour of the user, this RFC must be lodged correctly. However, that said: I am seriously considering permanently blocking this user for making extremely intimidating threats. I will not accept this sort of behaviour on Wikipedia, and I think I speak for all administrators when I say this. The user User:Truth Over Relationship is under notice that if they a stunt like that again I will stop them from contributing to Wikipedia. We don't need users who do things like this. - Ta bu shi da yu 07:25, 5 Mar 2005 (UTC)
TBSDY - can you point me to the direction of the template? I can't seem to find out how to do it properly. One Salient Oversight 09:47, 5 Mar 2005 (UTC)
Hello. In an action for alleged slander, you must show proof of special damage. That is, slander is not actionable without proof of special damage to your specific reputation. (see e.g. Barnett v Milner (1993) Aust Torts Rep 81-218).
In addition, when the allegedly defamatory material on the Internet was regarded as published - at the time and place where you downloaded it to your computer - you were bound by the terms of the Wikipedia:General disclaimer which charges that "None of the ... contributors ... can be responsible for the appearance of any ... libelous information...". This is likely to constitute consent at common law for the publication of the defamatory material.
The contributor in question may also be able to rely on the defences of truth and qualified privilege (the latter depends upon whether there is sufficient malice in law to destroy the occasion of qualified privilege, although this seems unlikely). Finally, the doctrine of fair reports may act to protect the user.
As you can see, any case for slander against this user is likely to fail. I suggest you stop making uninformed and hollow legal threats. - Mark 13:35, 5 Mar 2005 (UTC)
I am not a lawyer and this is not legal advice. The user of an anonymous IP such as 220.233.86.223 is generally known to their own ISP. If their ISP was legally compelled to do so for some reason (perhaps as a result of a subpoena), they could probably supply the identity of this user. You would have to supply the exact time and date that this IP was used for any activity you find objectionable, remembering to convert Wikipedia timestamps to your appropriate timezone. I have no idea if you have any legal standing to request any of the above, or if the user in question has done anything legally actionable by revealing your private information; only a lawyer could give such advice.
