There is no freedom of panorama in the United States for artworks making this a non-free image
see here as the art elements are the primary purpose of the image. As it's in a gallery it is likely to fail
WP:NFCC#8 even if marked as non-free

Painting by an unknown person. The painter has to have died prior to 1964 for this to be PD and there is no proof of this.

Although the uploader identifies as the heir of the subject of the photograph, there is no evidence that the uploader is the heir of the photographer.
