Original tag was {{Public Domain}}, which is deprecated now. The evidence given in the upload and the original web page is not enough for me to say with certainty whether it's in the public domain or not. -- LarryGilbert ( talk) 00:27, 19 October 2009 (UTC) reply

appears to be a painted portrait, not an original photograph, uploader may have taken a photograph of the portrait and not understood the nature of a derivative work. The small size of the file, tends to belie the uploader's claim of ownership. Lastly, Sethu Lakshmi Bayi appears to be about 35 in the portrait, which would mean that if it were a photograph that it was taken about 1930. Color photographs in 1930 were very rare. This is a cropped version of a file that was already deleted. The fact that it was posted on the U.S. Senate's website does not mean the government holds the copyright. Rrius ( talk) 05:47, 19 October 2009 (UTC) reply

Unlikely the uploader is the copyright holder. - FASTILYsock (TALK) 06:25, 19 October 2009 (UTC) reply
