The non-commercial restriction is false. Per Romanian law no. 8/1996, 14 March 1996, Chapter 3, Article 9, Section c states: official symbols of the State, public authorities and organizations, such as armorial bearings, seals, flags, emblems, shields, badges and medals shall not benefit from the legal protection accorded to copyright. Violates WP:NFCI and WP:NFC#UUI Wikipedia guidelines. Per this site], the author of this artwork is the renowned Dabawenyo sculptor Kublai Millan.
Firstly, this cannot be transferred to Wikimedia Commons because the Philippine copyright law does not permit a freedom of panorama exception allowing free sharing and distributions of images of copyrighted public art even under commercial Creative Commons licenses.
Secondly, this cannot be kept locally here on enwiki as it is not a building, but a sculpture. Per WP:Freedom of panorama, enwiki only follows US freedom of panorama, and US FoP only covers free uses of photos of architecture, not public art like monuments. Additionally, there is no way this image can be retained here as there is no article discussing the sculpture itself. Per WP:NFC#UUI: "a photo of a copyrighted statue (assuming there is no freedom of panorama in the country where the statue was when the photo was taken) can only be used to discuss the statue itself, not the subject of it." Also, images tagged as fair use ( WP:Fair use) are doomed to be deleted a week after being left unused, so even if the uploader tries to save his image by adding fair use tag, a bot will certainly tag is as "unused fair use file" and will be subjected to 7-day countdown to deletion.
