Uploader's claim of being the copyright holder is dubious. This image is found in a few other places on the internet like http://photosofmen.blogspot.ca/2012/08/fhrancis-oliver-lopez-when-he-was.html and uploder has made the same claim of copyright for another image which is a clear copyright violation. I asked Mjroots before uploading and he said that the file meets WP:NFCC. So I uploaded it. It is not a good idea to replace it with the file we previously used, because it does not show the attack or the outcomes of it. Cheers, FriyMan talk 20:08, 3 April 2017 (UTC) reply
With respect, the suggested replacement does not show the effects of the attack. Apart from the livery identifying the system, it could be any metro train anywhere in the world. All train/metro liveries etc are unique around the world and it's clearly obvious the other image was taken at the Russian station, Also we don't need images of the attacks etc etc unless their released under a commons license which this obviously isn't, Anyway the file has since been CSD'd as a copyvio. – Davey2010 Talk 20:18, 3 April 2017 (UTC) reply

It is not a copyright violation here on the English Wikipedia. However, because the image is from a commercial image agency (AP/Getty), it does not meet all of the non-free content criteria. See WP:F7 which specifically states that non-free images from agencies such as AP and Getty are eligible for immediate deletion. -- Whpq ( talk) 20:52, 3 April 2017 (UTC) reply

Because it would severely hamper other claims of fair use. In this case NFCC criteria 1 and 3-9 are met (I presume 10 is met but I haven't checked, and it's the easiest to correct if it isn't), however criterion 2 is not met as illustrating contemporary news and other articles about the attacks is how the news agencies make their money. If people can see the same image on Wikipedia then fewer newspapers, etc will pay to use the image, our use would therefore harm the copyright holder's commercial opportunities. My understanding is that this is one of the criteria that is most strongly linked to the requirements of fair use in copyright law, if so it is one of the least legally safe to ingore. This may be Flickrwashing. I'm not sure. The EXIF data clearly says the copyright holder is Trish Tunney and that All Rights Reserved. I emailed Ms. Tunney and am waiting for a reply. I asked Mjroots before uploading and he said that the file meets WP:NFCC. So I uploaded it. It is not a good idea to replace it with the file we previously used, because it does not show the attack or the outcomes of it. Cheers, FriyMan talk 20:08, 3 April 2017 (UTC) reply
With respect, the suggested replacement does not show the effects of the attack. Apart from the livery identifying the system, it could be any metro train anywhere in the world. All train/metro liveries etc are unique around the world and it's clearly obvious the other image was taken at the Russian station, Also we don't need images of the attacks etc etc unless their released under a commons license which this obviously isn't, Anyway the file has since been CSD'd as a copyvio. – Davey2010 Talk 20:18, 3 April 2017 (UTC) reply
Yes, it was CSD'd AT COMMONS as a copyvio, and quite correctly too. Use on en-Wiki under NFCC rules is a different matter. Mjroots ( talk) 20:20, 3 April 2017 (UTC) reply

It is not a copyright violation here on the English Wikipedia. However, because the image is from a commercial image agency (AP/Getty), it does not meet all of the non-free content criteria. See WP:F7 which specifically states that non-free images from agencies such as AP and Getty are eligible for immediate deletion. -- Whpq ( talk) 20:52, 3 April 2017 (UTC) reply

Because it would severely hamper other claims of fair use. In this case NFCC criteria 1 and 3-9 are met (I presume 10 is met but I haven't checked, and it's the easiest to correct if it isn't), however criterion 2 is not met as illustrating contemporary news and other articles about the attacks is how the news agencies make their money. If people can see the same image on Wikipedia then fewer newspapers, etc will pay to use the image, our use would therefore harm the copyright holder's commercial opportunities. My understanding is that this is one of the criteria that is most strongly linked to the requirements of fair use in copyright law, if so it is one of the least legally safe to ingore. This may be Flickrwashing. I'm not sure. The EXIF data clearly says the copyright holder is Trish Tunney and that All Rights Reserved. I emailed Ms. Tunney and am waiting for a reply. If they have authorized the Flickr upload I will close this myself. Otherwise without clarification we can't be sure this is properly licensed. Majora ( talk) 21:46, 3 April 2017 (UTC) reply
