We must not delete said image, because it falls under wikipedia's free-image domain. If the photographer claims that it is them, then we must give the photographer the benefit of a doubt. Unless the said actor who the photo is of can deny otherwise —Preceding

Scotland national football team with a caption of "Jim Baxter celebrates victory at Wembley". As this image is neither discussed nor referred to in the article in which it is used, and its rationale doesn't apply to its usage, it fails

Cloud Gate is a copyrighted sculpture, and in the US freedom of panorama does not extend to sculptures (see
Commons:Freedom of panorama for more details). We already have photos of Cloud Gate for which fair use claims have been made, so there is not really any need for another one.
