Commons tagging and licensing

Dear DogeGamer, Thank you for trying to help with image licensing of files that may recently have come into the public domain in the US! I looked through a couple of the images you tagged as fit for Commons, and I would like to alert you to a couple of things.

The first thing is that public domain status in the US depends on publication rather than mere creation 95 years ago. This can often be difficult to ascertain - for instance, according to its Sotheby listing File:Abstract rhythm of Mrs. M. S., Gino Severini, 1912.jpg does not seem to have been published before 1961, far too late to make it PD in the United States. Similarly, there is no evidence that File:1922 Tourist Trophy Winning Sunbeam.jpg has been published before 1929, as it was sourced directly to a company archive. As a print, early publication is a lot more likely than in the case of the painting, but it could still well be a work for hire on behalf of Sunbeam that never left the company. In any case, transfer to Commons additionally requires assessment of the copyright status in the source country. In the case of the painting by Severini, this is most likely to be Italy, and Italy grants protection for 70 years after the death of the artist (in 1963). So even if the painting had been published before 1929, it would definitely not be eligible for transfer to Commons on those grounds. Similarly, in the case of the Sunbeam print, assessment of the UK copyright status would require finding out who the original author is and when he lived, or determining for certain that the image was published anonymously. This is also difficult, especially since we know nothing about its publication modalities in the first place.

I'll have a look through the images you tagged recently, but do try to keep these issues in mind when tagging images (or moving them yourself) in the future.

Commons tagging and licensing

Dear DogeGamer, Thank you for trying to help with image licensing of files that may recently have come into the public domain in the US! I looked through a couple of the images you tagged as fit for Commons, and I would like to alert you to a couple of things.

The first thing is that public domain status in the US depends on publication rather than mere creation 95 years ago. This can often be difficult to ascertain - for instance, according to its Sotheby listing File:Abstract rhythm of Mrs. M. S., Gino Severini, 1912.jpg does not seem to have been published before 1961, far too late to make it PD in the United States. Similarly, there is no evidence that File:1922 Tourist Trophy Winning Sunbeam.jpg has been published before 1929, as it was sourced directly to a company archive. As a print, early publication is a lot more likely than in the case of the painting, but it could still well be a work for hire on behalf of Sunbeam that never left the company. In any case, transfer to Commons additionally requires assessment of the copyright status in the source country. In the case of the painting by Severini, this is most likely to be Italy, and Italy grants protection for 70 years after the death of the artist (in 1963). So even if the painting had been published before 1929, it would definitely not be eligible for transfer to Commons on those grounds. Similarly, in the case of the Sunbeam print, assessment of the UK copyright status would require finding out who the original author is and when he lived, or determining for certain that the image was published anonymously. This is also difficult, especially since we know nothing about its publication modalities in the first place.

I'll have a look through the images you tagged recently, but do try to keep these issues in mind when tagging images (or moving them yourself) in the future.
