Image copyright problem with Image:Starks.jpg

Thanks for uploading Image:Starks.jpg. However, the image may soon be deleted unless we can determine the copyright holder and copyright status. The Wikimedia Foundation is very careful about the images included in Wikipedia because of copyright law (see Wikipedia's Copyright policy).

The copyright holder is usually the creator, the creator's employer, or the last person who was transferred ownership rights. Copyright information on images is signified using copyright templates. The three basic license types on Wikipedia are open content, public domain, and fair use. Find the appropriate template in Wikipedia:Image copyright tags and place it on the image page like this: {{TemplateName}}.

Thanks for uploading Image:Lickingthemanshead.jpg. I notice the 'image' page currently doesn't specify who created the content, so the copyright status is therefore unclear. If you have not created this media yourself then you need to argue that we have the right to use the media on Wikipedia (see copyright tagging below). If you have not created the media yourself then you should also specify where you found it, i.e., in most cases link to the website where you got it, and the terms of use for content from that page.

If the media also doesn't have a copyright tag then you must also add one. If you created/took the picture, audio, or video then you can use {{ GFDL-self}} to release it under the GFDL. If you believe the media qualifies as fair use, please read fair use, and then use a tag such as {{ Non-free fair use in|article name}} or one of the other tags listed at Wikipedia:Image copyright tags#Fair_use. I deleted the image

Please STOP UPLOADING photos from the web

You have uploaded dozens of photos that you found on the web and marked them as PD (public domain) or NoRightsReserved. This is not correct — photos on the web are copyrighted and unusable by default unless you can find explicit written permission to the contrary (which is rare).

Many of the photos you have uploaded will likely have to be deleted; see the March 11 entries on WP:PUI.

Since you have persisted in uploading numerous copyrighted photos despite complaints (above), without even responding to the complaints, I have blocked you from editing Wikipedia for 1 week.

Steven johnson is only talking about 2 or 3 incorrectly tagged images. Most of the images were downloaded from the NBA photo store. Images from the NBA photostore are found throughout the Wikipedia.

After I am "unblocked" i will change the images to read copyright as follows

This is a copyrighted image that has been released by a company or organization to promote their work or product in the media, such as advertising material or a promotional photo in a press kit.

The copyright for it is most likely owned by the company who created the promotional item or the artist who produced the item in question; you must provide source information as evidence of ownership.

It is believed that the use of low-resolution images of promotional material

to illustrate the work or product in question; in the absence of free images that could serve such a purpose; on the English-language Wikipedia, hosted on servers in the United States by the non-profit Wikimedia Foundation, qualifies as fair use under United States copyright law. Note that 31 images uploaded by Fearingly were listed on WP:PUI on March 11, in addition to the images complained about above (which I have restored after Fearingly deleted these complaints ... you shouldn't normally edit/delete other people's comments on a Talk page). Yes, it's possible that some of the images are fair use, but only if they are correctly sourced and tagged.
