  2. ^ Vacancy not filled. See Supreme Court of Judicature Act 1881 (44 & 45 Vict. c. 68), s. 3.
  3. ^ New position authorised by the Supreme Court of Judicature Act 1875 (38 & 39 Vict. c. 77)

  5. ^ New positions authorised by the Supreme Court of Judicature (Amendment) Act 1938 (1 & 2 Geo. 6 c. 67)
  6. ^ Both forms appear in contemporaneous reports. The Law Journal of 14 February 1947 states that "his name now appears in the Daily Cause List under the title of Lord Justice Oaksey, a description, by the way, which does not of itself suggest that the learned Lord Justice is now a peer of the realm."
  7. ^ The Law Journal of 22 February 1946 states that "The appointment of Lord du Parcq as a Lord of Appeal made a vacancy in the Court of Appeal which it was appreciated would have to be filled without delay; but the appointment of two Lords Justices was not generally anticipated. When Lord Clauson (then Lord Justice Clauson) retired in 1942 the vacancy then created was not filled and the promotion of a Chancery Judge at this moment was therefore unexpected..."
  8. ^ New positions authorised by the Administration of Justice (Judges and Pensions) Act 1960 (9 & 10 Eliz. 2 c. 3)
  9. ^ According to The Times ("Two New Lords Justices, 16 September 1966): "The appointments are made necessary by the Criminal Appeal Act, which comes into force on October 1. The Act abolishes the Court of Criminal Appeal and transfers its jurisdiction to the new Criminal Division of the Court of Appeal. The two new Lords Justices, whose appointments increase the judicial strength of the Court of Appeal to the statutory maximum of 11, will engage in the general work of the Court of Appeal." Under the Administration of Justice (Judges and Pensions) Act 1960 (9 & 10 Eliz. 2 c. 3), the number of Lords of Justices was to be between eight and eleven.

On 25 April 1994, Sir Thomas Bingham MR issued a practice note stating that she should be informally referred to in court as "My Lady, Lady Justice Butler-Sloss" until the legislation could be amended.
