It's a large statue not a building. People can see it, they don't have to walk around inside it, so being private would only make a difference if it was hidden from public view.

Sounds unusual, do Krishna's head and shoulders pop over so are viewable? An image would help. Even if in private hands it still seems a notable artwork for size and presentation.

site (mentioned in the external links section) seems to have some photos of the installation. Seems highly visible. -
