The Genocide against the tutsi" captures the historical facts of what happened in 1994 — genocide against the Tutsi in Rwanda — and left no room for ambiguity. The tactics of genocide denial and revisionism were well known and documented. Some people promoted the theory of double genocide in the futile belief that it might divert their own responsibility. The more than 1 million people who perished in the genocide were killed in the most horrendous conditions because they belonged to a group that was dehumanized and targeted for total extermination"-Rwanda in General assembly,26 January 2018
Genocide requires a special intent. Indeed, to be qualified as genocide, a crime needs to fulfil at least three conditions: (1) it must be committed against members of a specific group listed in the Convention;a national, ethnic, racial, or religious group (2) the members must be targeted "as such" (as members of that group), and (3) they must be targeted with the intent to destroy them in whole or part.
Therefore, based on this definition, it's impossible that the 1994 genocide in Rwanda targeted Rwandans altogether, unless the author of "Rwandan genocide" suggests that (1) there were three separate genocides in Rwanda – one against each group:hutu;tutsi;Twa or (2) a single genocide against the Rwandan national group, which would mean that victims would have been targeted, not for their “ethnicity” but for their Rwandan nationality. And we know that both options are historically untrue.
2) The crime of genocide in a specific place doesn’t exist just because it was defined in an international convention. This crime needs to be established by a court of law, which has to demonstrate that members of one of the four groups mentioned in the Genocide Convention were targeted, as such, to be destroyed in whole or part.
For the case of Rwanda, the crime of genocide was established by the Trial Chamber of the UN International Criminal Tribunal for Rwanda (#ICTR) in its very first judgment, "Prosecutor against Jean-Paul Akayesu" of 2nd September 1998. In this judgement, the Tribunal concluded that “the crime of genocide was indeed committed in Rwanda in 1994 against the Tutsi as a group”.
This judgement was confirmed by the Appeals Chamber of the ICTR, which, on 16 June 2006, issued a judicial notice (ICTR-98-44-AR73(C)) that concluded that it was a “fact of common knowledge” that “between 6 April and 17 July 1994, there was a genocide in Rwanda against the Tutsi ethnic group”. This judicial notice settled, once and for all, the legal debate on (1) the qualification of the crime that was committed in Rwanda in 1994 – it was a genocide – and (2) the group that was targeted – it was the Tutsi ethnic group.Therefore it's not Rwandan Genocide but Genocide against the tutsi in Rwanda.
