Restaurant not a good example, because the law on eating out is a somewhat more complex. A person eating in a restaurant is not obliged to pay the bill if the food or service is not considered be of a standard commensurate with the price. As a result, precedent holds that no offence can be committed if the decision not to pay occurs after the food is ordered (in other words, the offence only occurs if the food was ordered with intent not to pay).
