As stated at WP:FUR, the issue is the replacability of this image. Wikipedia's criterion is that a obtaining free image is not feasible, not that one currently isn't available. In general, it is not acceptable to use a non-free image to illustrate what an actor looks like. -- Pak21 ( talk) 09:10, 29 November 2007 (UTC)
Description |
This image is a screencap from the 2007 television series Kid Nation. |
---|---|
Source |
CBS televised episodes (screencapped) |
Article | |
Portion used |
Detail of screencap to minimize use of copyrighted broadcast. |
Low resolution? |
Yes. It is a lower-resolution scan suitable for such illustration but little else. |
Purpose of use |
To show the participant from Kid Nation. Since the filming, the participant's appearance has significantly changed as she has grown (was age 12 at time of show's filming). |
Replaceable? |
No. Due to the young age, any photo taken today would fundamentally not depict the person in the same, recognizable way. |
Other information |
Minimal use does not infringe upon original owner's copyright. Used in Kid Nation to represent one of the show's most prolific and recognizable participants, and the only participant (currently) to have a solo Wikipedia article. Of note, the image was once deleted through subversion of the IMfD process (admin nominator closed discussion in own favor) at WP:IMfD71217#McGoff, which had followed a Fair Use Review at WP:FUR71129#McGoff that was requested but never completed. (Also see synopsis at VP:AA#Clear Agenda.) |
Fair use Fair use of copyrighted material in the context of Laurel McGoff//en.wikipedia.org/wiki/File_talk:Laurel_McGoff_(Kid_Nation)_SC.jpgtrue |
Furthermore, it could be very truly stated that, as a participant in a reality series, Laurel McGoff and others are not only the actors or actresses, but also the characters. With this reasoning (that of characters in a television series or film), fair-use standards are less stringent (even though this image meets the actor/actress standards, narrowly, in this case regardless). —Preceding unsigned comment added by VigilancePrime ( talk • contribs) 23:22, 2 January 2008 (UTC)
