The sitter was the son of Robert, 3rd Lord Elphinstone and his wife, Margaret, daughter of Sir John Drummond of Innerpeffray. He was made a member of the new Privy Council and was appointed a Lord of Session in 1599. He was Lord High Treasurer of Scotland from 1599 to 1601. He married Jean, the daughter of William, 6th Lord Livingstone, circa 1576.
