The image Image:Cap 170.gif is being linked here; though the picture is originally copyright, I ( Lajbi Holla @ me Who's the boss? 12:02, 4 June 2006 (UTC)) feel it is covered by fair use because:
- The image is a cover for the comics "Captain America" created by Marvel Comics, and intended for wide distribution.
- The cover is of lower resolution and quality than the original comics (copies made from it will be of inferior quality).
- No free or public domain images have been located for this comics.
- The cover does not limit the copyright owners' rights to distribute the comics or in any way.
- The cover is intended to represent the "Captain America" comics and its character Nefarius.
- The cover is being used for informational purposes only, and its use is not believed to detract from the original comics in any way.
